TUTU School Franchises, LLC (“TUTU School,“we,“us,” or “our”) respects your privacy and we are committed to protecting it through our compliance with this Privacy Policy (the “Policy”).

This Policy describes the types of information we may collect from you or that you may provide when you (all users) visit our website: https://www.tutuschool.com/ (the “Website”), use our online services (U.S. and Canada users) to attend live or recorded classes, register students for classes, camps, or parties, or interact with us (collectively, the “Online Services,”), use our in-person services (U.S. and Canada users) to attend in-studio classes, camps. and parties (the “Services”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

If you are located in the United Kingdom or the European Economic Area, please refer to the section below titled “Information for European Users” for more information about how TUTU School (and its independent franchisees) will use your personal information when you access services online and locally.

This Policy applies to information we collect:

  • On our Website.
  • In e-mail and other electronic messages between you and us.
  • When you use our Online Services, such as create an online account or register student for classes.
  • When you sign-up for our in-studio services.

It does not apply to information collected by:

  • use offline or through any other means, including on any other website operated by us or any third party (including our affiliates, subsidiaries, and independent franchisees); or
  • any third party, including through any application or content (including advertising) that may link to or be accessible from our Website.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Website, Online Services and/or Services. By accessing or using our Website, Online Services, and/or Services you agree to this Policy.

From time to time, we reserve the right to modify or amend the terms of our Policy. You will be notified of such changes by notifications on our Website, by e-mail notification informing you of such changes, or by any other reasonable means as required by applicable law. You should check this Policy frequently for any changes. Your continued use of our Website, Online Services, and/or Services following the posting of changes to this Policy will mean that you accept those changes.

1. Territorial Scope

This Privacy Policy applies to the use of our Website by all users. Additionally, it applies to our Online Services, and/or Services which are available for use only in the United States of America (the “U.S.“) and Canada. If you are located in the United Kingdom (“UK“) or the European Economic Area (“EEA“), please refer to the section below titled “Information for European Users” for more information about how TUTU School (and its UK and EEA independent franchisees) will use your personal information when you register for their local services online.

2. Additional Information for European Users

Our Website: If you are accessing our Website from the UK or the EEA, this Policy provides information about TUTU School’s processing of your personal information in connection with your use of the Website (please refer to the information set out in section 5 below, under the following sub-headings: Your Browser or Device, Third-Party Analytics and Targeted Marketing Analytics, and Cookies). With respect to this processing, TUTU School acts as a controller of your personal information.

Local schools: With respect to the collection (and use) of your personal information for purposes related to your accessing local services (including where you register online for a local TUTU school), please note that your local school (our independent franchisee) is the controller and information about their processing of your personal information can be found in their privacy notice. A link to your local school’s privacy notice is accessible via the relevant local school’s webpage and sets out important information about how your personal information will be used and how to exercise your rights.

Co-operation and assistance. If you have any questions or concerns, you can still contact TUTU School. TUTU School acts as a service provider to our independent franchisees (i.e., your local school) and in accordance with our responsibilities as a processor, we will co-operate with our independent franchisee to assist in providing you with an appropriate response to any requests you may make.

Local school closure. In the event that a local school (operated by one of our independent franchisees) ceases to be part of the TUTU School network, is sold or transferred, or otherwise ceases to do business, TUTU School may take over the relationship with you (including to ensure continuity of services to you, alert you of any changes in personnel, schedules or locations, or to answer any questions you may have). In such a situation, TUTU School will use your personal information in accordance with the local school’s privacy notice and you will be notified in advance of this change.

  • Consents. We seek your consent prior to our deployment of cookies or similar technologies when you access the Website, where consent is required by applicable law. You can change your cookie consent selections at any time by clicking on the cookie icon and selecting “change your consent”.
  • Use of your personal information. Generally speaking, we use cookies (and similar technologies) to personalize content and ads, to provide social media features and to analyze traffic on our Website so that we can provide the best version of our Website to our users. We also share information about your use of our Website with our social media, advertising and analytics partners who may combine it with other information that you’ve provided to them or that they’ve collected from your use of their services.     Please also note, Tutu School maintains strict privacy policies to protect the personal information of our users obtained for text message communications. This information is never sold, rented, released, or traded to others without prior consent or legal obligation. Any sharing of information with third parties is solely for the purpose of fulfilling the organization’s obligations to the user. We guarantee that it will never be shared with third parties for marketing purposes.

    Regarding Tutu School’s Text Message Opt-Out, as noted below in Section No. 10, if you are receiving text messages from us and wish to stop receiving them, simply respond with either “STOP” or “UNSUBSCRIBE” to the number from which you received the message. Alternatively, you may email us at [email protected] to opt-out of text messages with a subject “STOP TEXT MESSAGE.” Once we receive your message, you will no longer receive further text messages from us.

  • Legal basis. When we use personal information captured via the use of cookies or similar technologies, we generally rely on your consent as the legal basis for processing. However, where we have not collected your consent because the cookie or similar technology is “necessary” (and, therefore, consent is not legally required) our processing of any associated personal information is undertaken on the basis of our legitimate interest (i.e., our interests in ensuring that our Website functions properly, that we are able to provide the user experience you request or expect and to ensure our Website is free of errors, bugs and bots).

Your rights. Individuals located in the UK and EEA have the following data protection rights. To exercise any of them see specific instructions below or contact us using the contact details provided under the “How to contact us” heading.

  • You may access, correct, update or request deletion of your personal data.
  • You can object to processing of your personal data, ask us to restrict processing of your personal data or request portability of your personal data, (i.e. request that your personal data to be transferred in a readable and standardized format to a third party).
  • You have the right to opt-out of marketing communications we send you at any time 9this includes your right to withdraw your consent to any cookies we have set for any marketing purpose – see the information set out above which explains how you can exercise this right).
  • If we have collected and processed your personal data with your consent, then you can withdraw your consent at any time by using the contact details provided under the “How to contact us” heading below. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal data conducted in reliance on lawful processing grounds other than consent.
  • You have the right to complain to a supervisory authority about our collection and use of your personal data. For more information, please contact your local supervisory authority.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

3. Minors and Children Under the Age of 13

Our Website, Online Services, and Services are available to children under the age of 13 years only with the consent of their parents or legal guardian. Further, we do not knowingly collect personal information from children under age 13. Any personal information about children under age 13 is provided to us by the parent or legal guardian. If we determine that a customer is under the age of 18 and we do not have the consent of their legal parent or guardian, we will immediately terminate the associated account, if any, and delete any information provided. Any parent or legal guardian who has provided consent to us but wants to withdraw it should contact us. Additionally, if you believe we might have any information from or about a child under 18 without appropriate consent, and especially information from or about a child under 13, please contact us. 4. Information We Collect About You

We collect Personal Information (defined below) and information that is not Personal Information (“Non-Personal Information,” together with Personal Information, “Information“) regarding users of the Online Services and/ or Services or relating to the Online Services and/or Services, either directly or through the activities of third-party suppliers and service providers and/or franchisees. For purposes of this Policy, “Personal Information” means the information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a person. We may combine Non-Personal Information with Personal Information, and in those circumstances we will treat the combined information as Personal Information. We collect several types of Personal Information from and about users of our Website, Online Services, and/or Services, including the following Personal Information and Non-Personal Information:

  • Your First and Last Name
  • First and Last Name of your Child
  • Your Child’s Birthday
  • Your Email Address
  • Your Cell Phone Number
  • Your Home Phone Number
  • Your Street Address
  • Your Child’s Emergency Contact Information
  • Any Pertinent Information Specific to Your Child that You Choose to Share (e.g. any health conditions, illnesses, allergies, and related items)
  • Geolocation and IP Address
  • Credit Card Information (This is collected by our third-party payment processing partner. We do not receive your credit card information except to the extent we may assist you in processing transactions via phone or online.)
  • Persistent online identifier (e.g., persistent cookie)
  • Inquiry information, such as your questions/feedback to us or survey responses

5. How We Collect Your Information

We collect your Information from various sources (including from our franchisees) that may include, for example, from:

  • You Directly.Information you provide directly when you use or otherwise interact with our Website, Online Services, and/or Services; establish an online account; sign-up you child for our classes, camps, or parties, complete a survey; contact us; provide feedback and/or submissions; or submit Information through our Website, Online Services, and/or Services, in connection with our Services.
  • Your Browser or Device.Information collected automatically as a result of your interaction with us, our franchisees and/or use of the Online Services or Services (including historical sales information, your geolocation information (which may include specific longitude and latitude), usage times and volume, and information about the device you are using (for example, device type, device ID, characteristics and status, browser type, operating system and application version and information about how our application is used) or through our marketing activities. We use Google Analytics to collect such data. Terms of Service for Google Analytics are available here: https://www.google.com/analytics/terms/us.html.

    Third-Party Analytics and Targeted Marketing Analytics. We partner with third-party suppliers to engage in analytics, analysis, auditing, measurement, research, and reporting, including without limitation based on Personal Information or other Non-Personal Information collected over time, such as through your activity on the Online Services and Services, your device’s geolocation (which may include specific longitude and latitude), and your activity on unaffiliated third-party sites, mobile apps, or other online services. Our third-party partners may use web logs or pixels, and/or they may set and access cookies or other tracking technologies on your computer or other device. For example, we may use Google Analytics and/or other third-party services to help collect and analyze certain Information for the purposes described in this Policy, including to evaluate our targeted marketing activities. We may use this data in individual form, in a format that that does not, by itself, identify you individually and/or aggregated form, we may share information that does not, by itself, identify you individually and/or aggregated information and/or statistics with others outside of TUTU School and we may allow third parties to collect and aggregate Non-Personal Information in connection with the use of tracking technologies. Your Personal Information may also be used for analytics related to tracking your activities on the Online Services.

    Cookies. We may also use cookies to collect the above information. Cookies are small files of letters and numbers stored on your browser or device that enable the cookie owner to recognize the device when it visits websites or uses online services. The website you visit may set cookies directly, known as first-party cookies, or may trigger cookies set by other domain names, known as third-party cookies. While we may automatically use some cookies that are strictly necessary to provide the services you request or enable communications, we request your consent for all of our other cookie uses.

    We may use the following types of cookies:

    • Analytical/performance cookies. These cookies allow us and our third-party service providers to recognize and count the number of visitors and to see how visitors move around our website when they are using it. This helps us improve how our website works by, for example, ensuring that users can easily find what they need on our website. These cookies generate aggregate statistics that are not associated with an individualized profile.
    • Functionality cookies. These cookies enable helpful but non-essential website functions that improve your website experience. By recognizing you when you return to our website, they may, for example, allow us to personalize our content for you, greet you by name, or remember your preferences.

  • Third Party Service Providers.Information we collect about you from our third-party service providers, such as our payment processing partners. TUTU School does not receive any of your payment related information, except for a confirmation that the payment has been made and subsequently processed. Please review such third-party’s privacy policy, which is available on their respective website.
  • Social Media Networks.Information that your social media network provides to us if you connect your social media account with TUTU School. For example, this may include your social media ID or username, name, email address, general location, friends list, and demographic information such as gender or birthday/age. Note that certain of the information we receive will become part of your account(s) with TUTU School and will be subject to this Policy.
  • Otherwise in accordance with our agreements with you.Information as described elsewhere in this Policy, any applicable terms, or at the time such information is collected.

6. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the information you provide to us. We have created mechanisms to provide you with the following control over your information:
  1. Do Not Track.Do Not Track is a privacy preference that can be set in a web browser. At this time, we do not respond to Do Not Track browser settings or signals.
  2. Disclosure of Your Information for Third-Party Advertising.We do not sell, trade, or otherwise transfer your Personal Information unless we provide you with advance notice. However, this does not include disclosure of your Information to our franchisees, website hosting partner, and other third parties listed under the Disclosure of Your Information section who assist us in operating our Website, conducting our business, or servicing, so long as those parties agree to keep your information confidential.
  3. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

7. How We Use Your Information

We use information that we collect about you or that you provide to us, including any Personal Information:
  • To present our Website and its contents to you, as applicable.
  • To provide you with our Online Services and Services.
  • To provide you with information, products, or services that you request from us.
  • To notify you about changes to our Website, Services, or any Online Services we offer or provide though it.

We may disclose aggregated information about our users and information that does not identify any individual, including Non-Personal Information, without restriction.

  • To our franchisees, subsidiaries and affiliates on a need-to-know basis.
  • To contractors, service providers and other third parties, such as our payment processing partners, that we use to support our business and who are bound by contractual obligations to keep Personal Information confidential, in compliance with the applicable privacy laws and regulations, and use Information only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by us about our Website, Online Services, and/or Services users is among the assets transferred.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your Personal Information:

  • To comply with any court order, law or legal process, including to respond to any government or regulatory request.
  • To enforce or apply other agreements, including for billing and collection purposes.

9. Third Party Links On Our Website

Our Website may contain links to other third party websites for your convenience. We are not responsible for the privacy policies and practices of other third parties and any information you submit to a third party is subject to their privacy policy. Once you leave our Website, or are redirected to a third-party website, application, or other online service, we encourage you to read the privacy policy applicable to that third party.

10. Opt-Out of Communications with TUTU School

  1. E-mail Contact.You may opt-out of receiving promotional e-mail communication from us by sending us an e- mail at [email protected]. Please note that you will not be able to opt-out of transactional e-mail communication, such as communication related to your account or our Online Services or Services. In addition, you may click on the “unsubscribe” button in the footer of the email that we send.
  2. Text Notification.You can opt-in to receive our text message by providing us your cell phone number. You can opt-out by texting STOP to the message that you receive from us. Alternatively, you may email us at [email protected] to opt-out of text messages with a subject “STOP TEXT MESSAGE.”

11. Accessing Your Information and Deleting Your TUTU School Account

It is important that the Personal Information (and Information generally) that we hold about you is accurate and current. Please keep us informed if your Personal Information changes.

Where you have previously provided your consent to the collection, use, and transfer of your Personal Information, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, contact us at [email protected]. Please note that if you withdraw your consent we may not be able to provide you with a particular product, the Online Services, or Services.

Deleting Your Account.You may delete your account by contacting [email protected]. Please note that by deleting your TUTU School account you may not be to access our Online Services or Services.

For Canadian Residents:By Canadian law you have the right to request access to and to correct the Personal Information that we hold about you. If you want to review, verify, correct, or withdraw consent to the use of your Personal Information you may send us an email at [email protected] to request access to, correct, or delete any Personal Information that you have provided to us. Moreover, you may edit or delete your account by logging into your TUTU School account. We cannot delete your Personal Information except by also deleting your user account – see above. We may not accommodate a request to change Information if we believe the change would violate any law or legal requirement or cause the Information to be incorrect.

Verifying Your Identity.We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the Personal Information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to all or part of your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

12. Your California Privacy Rights

We do not sell, trade, or otherwise transfer to outside third parties your Personal Information. California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Further, the California Consumer Privacy Act of 2018, as amended (Cal. Civ. Code §§ 1798.100 to 1798.199) including the California Privacy Rights Act (collectively, “CCPA”), does not apply to us. 13. Data Processing and Security

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, by encrypting data in transit, we cannot guarantee the security of your Personal Information transmitted to our Website. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

Data that you provide is hosted on dedicated servers of our third-party partners.

For users located in Canada, we may process, store, and transfer your Personal Information (and Information, generally) in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. In particular, Information may be transferred to, and processed and stored in, the U.S., including for the purposes of providing requested services to you and notifying you of upcoming events and offers. In particular, you should be aware that any health information you choose to disclose about your child (including any medical conditions or allergies) to us may be transferred to, and stored on, our servers located in the U.S. Information regarding our policies and practices concerning the use of service providers outside of Canada can be obtained by e-mailing the address listed in Section “15”, below.

14. Data Retention

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you. We reserve the right to retain and use such anonymous and de-identified data (including all Non-Personal Information) for any legitimate business purpose without further notice to you or your consent.

15. Changes to Our Privacy Policy

It is our policy to post any changes we make to our Privacy Policy on this page, or by sending you an e-mail notification, or any other method prescribed under applicable law. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring that we have your up-to-date active and deliverable email address, and for periodically visiting our Website and this Privacy Policy to check for any changes.
